LEGAL NOTICE

    Under instructions from and on behalf of my Client above said, and on the basis of the documents placed before me, I hereby serve upon all of you the following Legal Notice.

1.    That in response to my legal notice dated -------------------- sent to all of you, the Addressee, by COURIER/REGISTERED A.D/SPEED POST/U.P.C. My Client, M/s ------------ having its registered office at ---------------, duly represented through its Managing Director, ------------, had on ----------------presented himself in the Office of Sub-Registrar, ------------, along with the following payments to perform his part of the contract which is more particularly set out in the legal notice dated ------------ sent to all of you’re the Addressees, to get the Sale Deed in respect of Plot No.---------------------------------, executed and registered in favour of My Client, M/s ------------------------------------------------ :- 

  1. Pay Order No.----------- dated -------------drawn on -------- for Rs.--------------- and in favour of  M/s ---------------------------------------------------------------------

  2. Pay Order No.----------- dated -------------drawn on -------- for Rs.--------------- and in favour of  M/s ---------------------------------------------------------------------

  3. Cash amounting to Rs.------------------ for purchase of the requisite Stamp Paper for execution and registration of the Sale Deed in respect of Plot No.---------------------, executed and registered in favour of My Client, M/s ----------------

2.    That My Client has instructed me that none of you, the Addressees, had presented himself on ----------- in the Office of Sub-Registrar, ------------ to discharge your part of the obligations i.e. to execute and register the Sale Deed in respect of Plot No.--------------------------, in favour of My Client, M/s -----------------------. 


3.    That on behalf of My Client I further notify you that My Client has already recorded his presence on ---------- in the Office of Sub-Registrar ------------, along with the following payments :-


  1. Pay Order No.----------- dated -------------drawn on -------- for Rs.--------------- and in favour of  M/s ---------------------------------------------------------------------

  2. Pay Order No.----------- dated -------------drawn on -------- for Rs.--------------- and in favour of  M/s ---------------------------------------------------------------------

  3. Cash amounting to Rs.------------------ for purchase of the requisite Stamp Paper for execution and registration of the Sale Deed in respect of Plot No.---------------------, executed and registered in favour of My Client, M/s ----------------

for execution and registration of the Sale Deed in favour of My Client, M/s -------------- in respect of Plot No.---------------------------------------------------.


4.    That under instructions of My Client, I hereby further notify you that in view of the circumstances narrated hereinabove My Client is now left with no other option  but to proceed to cancel the Pay Orders mentioned at para 3 (I) and  (ii) above and deposit the proceeds of the same in his bank account, and also to deposit the proceeds of the same in his bank account, and also to deposit into his account the Cash amounting to Rs.------------------ which he had withdrawn for purchase of the requisite Stamp Paper for execution  and registration of the Sale Deed in respect of Plot No.----------------------, in favour of M/s ------------------------.


You may further note that in case you ever wish to present yourself in the Office of Sub-Registrar, ------------, for receiving the payments mentioned at para 1 (i), and (ii) above in discharge of your part of the obligations under the Agreement to Sell dated --------- read with letter dated --------------- for execution and registration of the Sale Deed in respect of Plot No.--------------------, in favour of M/s ----------------- then in that case, all of you, the Addressees, are notified to give six weeks advance notice to My Client, M/s ------------------, who will then present himself in the Office of Sub-Registrar, ------------ to fulfill his part of the obligations under the Agreement to Sell dated ------------ read with letter dated -------- for execution and registration of the Sale Deed in respect of Plot No.------------------, in favour of M/s --------------


Take notice accordingly. Needless to mention that the present notice is without prejudice to the rights of My Client to proceed against you in accordance with law.
