 Powers and jurisdiction of High court 

This is one of the most important part of the that we should be know before going to hierarchy of the courts . There are three types of courts Supreme court to High court to subordinate court .  In the subordinate court we can file in the case . This specialty of this court is that the case can be heard in their own language . In high court other advantage is that if the person is not satisfied with the high court they can go for appeal at high court . In the supreme court it is the final court where the case is been heard and the final judgment are made . Hereafter there is such court above. 

There are three types of jurisdiction :

Original jurisdiction

Appellate Jurisdiction 

The high have the power to hear and decide the cases is known as Original jurisdiction. In appellate jurisdiction the high court hear to decide the cases which are from the subordinate court is known as appellate jurisdiction .  In the high court where most of appeal are been heard civil and criminal cases .

Original jurisdiction

The court has power to hear and decide cases which are brought directly is called original jurisdiction  . The scope are limited . Cases are been violated most in case of fundamental right. In the article 42 of the constitution it talks about where the 5 writs specially I am talking that are Heabus corpus , quo warranto , certiorari, . In the high court appeals against the judgement of the subordinate court or lower court . In civil cases appellate jurisdiction it extends all cases up to 5 ,oo,ooo lakhs .   

Appellate jurisdiction

In appellate jurisdiction in this type the cases are been heard through appeals . In this type person who does not satisfy with the judgment can go for the High court . One of example where one famous case Bishop Franko case the judgement where it was against justices not delivered to the sister in the church which she was raped multiple times .

Transfer of cases to the subordinate court 

If the high court satisfied if the case pending in the involving in the substantial matter. If there is question of law in which there is interpretation of the constitution.


Superintendence’s of Subordinate court  

High court has right of Superintendence’s over all other high court . 

Court of record 

Court is the where all the precedents should be kept in either soft copy of hard copy of the data. In this case it is mandatory for the court to keep the precedent or previous judgement .like Indian Kannon , Mau Patra . 

There are specific restrictions or rules that are made on each for it own principle . Because like we know the three organs judiciary , Executive , Legislative etc. . Judiciary is independent where it has power over the three organs . Legislative where they make the law , Executive where they execute the laws.
