IMPORTANCE OF MOOT COURT
INTRODUCTION
Moot court is an inevitable factor in the life of a law student. It’s the closest thing they can have to an actual court room experience.
In moot court students will have to argue hypothetical scenarios as either petitioner or respondent. The case scenario would be totally imaginary. Legal luminaries or academicians would also be invited to act as the judge of the court. The whole procedure of the court would be same as an actual court.
IMPORTANCE
In our Indian education system practical knowledge has always been weighed less but for a lawyer having practical knowledge is the key. Just having great knowledge about each and every statute ever written will not make someone a great lawyer, along with that knowledge they should also know how to apply the law to the present scenario. Student must have the ability to recall and apply the provision to the case which is given before them.
Another great importance of mooting is that it boosts the self confidence level of student. They would be nervous to appear before the court for the first time and by attending moot court they would be reassured that they can do this. Having self-confidence is of course a major trait of a good lawyer.
By attending several moot courts, the student would get adapted to the procedure of the court. They will be more familiar with the surroundings of a court and will understand how to behave in a court. All the phrases that are used inside the court room will also come in handy. I personally think that competing in a moot court competition would impart added benefits to the participants rather than practicing mooting in their own college as just a study material.
While attending to a moot court competition students would have larger exposure to the legal world and community. A good lawyer should always have strong connections in the society so participating in a moot court competition where students can show case their talents would be a door to that.
The most important advantage is that moot court competitions would prepare the students to accept failures. In this profession every one tends to face set backs and defeats so, the experience of moot court competition would help them adapt to it.
Moot court competitions are always between 2 teams of 3 people in that, one person would be the researcher. Special award for best memorials are also awarded at mot court competitions, this would definitely help the students to improve their drafting skills.
These are the main features and importance of moot court.
CONCLUSION
Mooting boosts the efficiency and skills of a law student. In India, mooting started wen Bar Council of India (BCI) organized the Bar Council of India moot court in 1985. From that time mooting culture is being followed by Indian law students.
Nowadays most moot courts are happening through the online platforms which has its fair share of positives and negatives. Students are able to compete from anywhere in the world but they will not be able to benefit from it to the fullest since there would be technical issues. In this covid era online moot courts have some limitations but it doesn’t make it any less important.
