 Sedition as per the Ipc 

In one of the most important concept and one of the interesting topic is sedition in Ipc . As per the Ipc there are some essentials which should be kept in mind while we are going through the section . Because dividing the essentials we can better the foundation will be stronger in concepts . 

As per the section it talks about whosever is against the government in the form of gesture , signs , either spoken or written word which they are visible shall be fined with the imprisonment  for three years .  Dividing it into four essentials

Essentials of Sedition of Ipc 

Whosever either spoken or words 

Signs 

Visible

To attempts to excite dissatisfaction towards the government law .

In this case there is question arise in most of the people is there any violation  of the article 19 or is there any infringement .  But some extent in my opinion is yes . In this article it is talking about where there is right to express our freedom to speech our expression . It is our freedom to give our speech towards our expression on any opinion . But there is restriction which are mentioned . There was famous trial that was been initiated or we can say there is background history. Bal Gangadhar tilak was one of the freedom fighter who colonized in sedition in Ipc . Other freedom fighter Mahatama Gandhi was other person who was arrested in the colonial period . What happened was that . He was writing the article against the government four articles .  Where the British government   was been frustrated . He was moved to jail . Again he was subjected to cruelty . Because of his influencing speech .He was been subjected to cruelty . 

There may be some sought of constitutionality which are been effected towards the article related to freedom of speech .  It is been criminalized under the act . There was recent case where a person was been filed in sedition under 120 A in which he was posting poster towards highest authority . Here was there for fine .  But there is restriction because we cannot oppose the government decision . Like right to assemble without arms . There is also restriction where there we cannot assemble destroying peace . Similarly here also we can express our freedom and thoughts should be right way right manner . 

This which should be kept in mind before we read . Other famous case where same scenario a person was filed case where abusing the government where he was filed under same section . One or the other it has pros and cons on the topic . Here in this case we have right to express our speech. Because in the ancient time where our freedom fighters fight against the government . But due to the fear . The government tried to  put this as defences for the protection for them .
